PACLARA / Legal information

Paclara Terms of Use

Effective date: 24 October 2026

These Terms of Use govern your use of the Paclara mobile application and related services.

They also constitute the regulations for the provision of services by electronic means (regulamin świadczenia usług drogą elektroniczną) to the extent required by applicable Polish law.

1. Provider

Paclara is provided by:

Max Poplawski
Email: support@paclara.com

General enquiries may also be sent to hello@paclara.com.

In these Terms, “Paclara”, “we”, “us” and “our” refer to Max Poplawski as the provider of the Paclara application.

2. What Paclara is

Paclara is a creator collaboration management application designed to help content creators organise the commercial side of their work.

Depending on the version and features available to you, Paclara may allow you to:

Paclara is a planning, organisation and pricing-support tool. It does not act as your agent, manager, lawyer, accountant or financial adviser.

3. Requirements for using Paclara

To use Paclara you need:

Some functionality may additionally require:

The current technical requirements may change as Paclara and Apple platforms develop.

4. Starting and ending use of Paclara

You may begin using Paclara by downloading and using the application.

No separate Paclara account is required for the core iPhone application.

You may stop using Paclara at any time. You can remove the application from your device and, where relevant, manage or cancel a Paclara Pro subscription through Apple's subscription-management tools.

Deleting the application, cancelling a subscription and deleting data are separate actions. Removing the app does not necessarily cancel an active App Store subscription, and cancelling a subscription does not automatically delete information stored on your device or in iCloud.

5. Free version and Paclara Pro

Paclara may offer both free functionality and optional paid functionality through Paclara Pro.

The functionality included in each version may be described in the application and on the App Store.

Paclara Pro subscriptions are purchased through Apple's App Store and may be offered on a recurring monthly or annual basis.

Apple handles the purchase process, billing, payment methods, renewals, cancellation and applicable refund mechanisms through the App Store and StoreKit.

Prices displayed by Apple may vary by storefront, country, currency and applicable taxes.

Your purchase and use of an App Store subscription may also be subject to Apple's applicable terms and conditions.

Nothing in these Terms limits any mandatory rights you may have under applicable consumer law.

6. Your information and local-first storage

Paclara is designed as a local-first application.

Information you enter into Paclara is generally stored on your device unless you choose to use a feature that involves another service, such as iCloud Sync, an export, a backup or an Apple-managed purchase service.

If you enable iCloud Sync, eligible Paclara information may be stored in and synchronised through the private CloudKit database associated with your Apple Account.

You are responsible for ensuring that information you enter into Paclara is accurate and for maintaining appropriate backups where the information is important to you.

Further information about how Paclara handles information is available in the Paclara Privacy Policy.

7. Price a Deal

Price a Deal is a pricing-support feature intended to help creators consider what they may wish to charge for a potential collaboration.

Where available, it uses information from your own completed collaborations together with information you provide about a new opportunity and applies Paclara's pricing model to produce a suggested price or pricing range.

A pricing suggestion is not a valuation, guarantee, market quotation or recommendation that a brand will accept a particular price.

It does not represent the rates charged by other creators and should not be treated as legal, financial or commercial advice.

You remain responsible for deciding what to charge and whether to accept, reject or negotiate any commercial opportunity.

8. Conflict checking, exclusivity and boosting

Paclara can help compare a potential collaboration with restrictions and commitments you have previously entered into the application.

Paclara relies on the information you provide.

It does not independently determine:

Paclara keeps exclusivity or non-compete restrictions separate from advertising, paid-media and boosting periods.

Conflict results are organisational prompts designed to help you review your existing commitments. They are not legal conclusions.

You should always check the relevant agreement before entering into a new collaboration.

9. Contract Review

Where supported, Paclara may allow you to review certain contract documents using Apple on-device technology.

Contract Review is designed to identify and organise information for you to check, such as:

Contract Review may be incomplete or incorrect.

It does not provide legal advice, interpret the legal effect or enforceability of contractual provisions, or replace your own review of the original agreement.

You are responsible for reviewing and confirming information before relying on it or saving it to a collaboration.

Supported document types, languages and device requirements may change over time.

10. Reminders and notifications

Paclara may allow you to create reminders or receive notifications about dates and tasks.

Notifications depend on your device settings, operating system, permissions and Apple services.

You should not rely on Paclara as the sole means of remembering a legally, financially or commercially important deadline.

11. Acceptable use

You must not use Paclara:

You remain responsible for information, documents and other content you choose to store or process using Paclara.

12. Intellectual property

Paclara, including its software, design, branding, text, interfaces and original content, is protected by applicable intellectual-property laws.

Subject to these Terms and any applicable App Store terms, you are granted a personal, limited, non-exclusive and non-transferable right to use Paclara for its intended purpose.

This does not transfer ownership of Paclara or any intellectual-property rights to you.

You retain any rights you have in the information and documents you enter into Paclara.

13. Availability and changes

We aim to keep Paclara available and functioning properly, but continuous or error-free availability cannot be guaranteed.

Features may change as Paclara develops, including because of:

Where a change materially affects rights that cannot lawfully be changed without notice or consent, applicable law will apply.

14. Liability and important limitations

Paclara is intended to assist with organisation and decision-making.

In particular:

You remain responsible for reviewing your contracts, deadlines, commercial commitments, invoices and decisions.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including mandatory consumer-protection rules.

15. Complaints and support

If Paclara does not operate as expected or you wish to make a complaint, contact:

support@paclara.com

Please provide enough information to identify the issue, such as:

Do not send passwords, unnecessary personal data, confidential contracts or sensitive information unless specifically required to resolve the issue.

We will consider complaints within a reasonable period and in accordance with any mandatory time limits imposed by applicable law.

16. Consumer rights

If you use Paclara as a consumer, you may have mandatory rights under the laws applicable to you.

These may include rights relating to digital content or digital services, conformity with the contract, remedies where a digital service does not conform to the contract, information provided before purchase, and rights relating to distance contracts.

Where Paclara Pro is purchased through the App Store, Apple provides the purchase interface and handles billing and the mechanisms available through the App Store for managing subscriptions and requesting refunds.

Nothing in these Terms removes or restricts rights that cannot legally be excluded or limited.

17. Third-party services

Paclara relies on or may interact with services provided by third parties, particularly Apple, including:

Those services are operated by Apple and may be governed by Apple's own terms, policies and availability.

We are not responsible for interruptions or changes to third-party services outside our reasonable control.

18. Ending the service

You may stop using Paclara at any time.

We may discontinue Paclara or particular features where reasonably necessary, subject to applicable law and any obligations relating to paid services.

Where practical, reasonable notice will be given before discontinuing functionality that materially affects existing users.

Your rights relating to an active subscription remain subject to applicable law and Apple's App Store mechanisms.

19. Changes to these Terms

These Terms may be updated where necessary, for example because Paclara changes, new functionality is introduced, or legal requirements change.

The current version will be published on the Paclara website together with its effective date.

Where applicable law requires advance notice, consent or another specific procedure before a change takes effect, that procedure will be followed.

20. Applicable law

These Terms are governed by Polish law, subject to any mandatory protections available to consumers under the law that applies to them.

Nothing in this section deprives a consumer of protections that cannot legally be excluded by an agreement on governing law.
